Is it legal to use AI to answer your calls? Disclosure and recording explained

A plain guide to AI call answering, caller disclosure and call recording rules in Australia, the US and the UK, and how to set up your assistant responsibly.

By Code Alpha AI team ·

Using an AI assistant to answer your own phone is legal in most countries. What matters is how it is done: telling callers they are speaking with an AI, and following the rules for recording calls. This guide explains the basics. It is general information, not legal advice; check the rules where you and your callers are.

Rule 1: tell callers it is an AI

Being upfront is the safest and most respectful approach, and a growing number of laws and regulators expect it. A simple line at the start of the call is enough: "Hi, you've reached Sam's AI assistant."

Alpha Assistant always introduces itself as an AI assistant. See our AI disclosure.

Recording rules differ by country and, in some countries, by state.

United States

  • Federal law and most states allow recording when one party to the call consents.
  • Some states, including California, Florida and Washington, require all parties to consent.
  • Because callers can be anywhere, the practical approach is to tell every caller the call may be recorded.

Australia

  • Recording laws are set by each state and territory and differ in detail.
  • Telling callers at the start that the call is with an AI assistant and may be recorded is the sensible baseline.

United Kingdom

  • Individuals and businesses can usually record calls, but using and storing recordings is covered by data protection law (UK GDPR). Tell callers and keep recordings secure.

Rule 3: handle the data carefully

  • Keep recordings and transcripts private and secure
  • Keep them only as long as you need them
  • Let callers ask for their information to be deleted where the law requires
  • Don't let the assistant make commitments you haven't approved

Rule 4: you stay in control

A good assistant suggests and prepares, and you decide. With Alpha Assistant, you approve actions such as call-backs and messages with one tap.

A responsible setup checklist

  1. The greeting says it is an AI assistant
  2. Callers are told the call may be recorded
  3. Summaries and recordings are stored securely
  4. You review before anything is sent or booked on your behalf
  5. You know the rules for the main places your callers are

Frequently asked questions

Do I need consent to have an AI answer my phone?

Answering your own phone with an AI is generally fine. Recording and disclosure rules are what need attention.

Is an AI call assistant covered by telemarketing rules?

Rules for automated marketing calls apply to outbound marketing. An assistant answering calls you receive is different. If you use AI to make outbound calls, make sure they are wanted calls, like call-backs.
